The Court of Magistrates has cleared Christian Borg of perjury allegations due to the prosecution’s inability to provide a transcript of the allegedly false testimony.
In its decision, the court emphasized that the prosecution had not fulfilled the necessary burden of proof, highlighting that determining the truthfulness of the testimony was “impossible without the essential records of what was said.” Borg faced charges of providing false evidence and swearing a false oath in a civil proceeding before Magistrate Gabriella Vella on January 22, 2021.

Though the prosecution did present an affidavit from a police officer, a copy of the court order requesting action against Borg, and documentation confirming his residence, it crucially did not submit the key court transcript that would detail the purportedly false testimony.
