In the latest developments in the Vitals Global Healthcare / Steward healthcare freezing order proceedings, presided over by Madame Justice Edwina Grima, the court once again expressed deep frustration over the continued refusal of court-appointed expert Jeremy Harbinson to appear before the Maltese courts.
Despite repeated summons and clear court orders, Harbinson has failed to testify in connection with the Vitals hospitals deal. His continued absence has effectively stalled an important part of the judicial process, drawing increasing concern from the bench.
Judge Grima made it clear during the latest sitting that the Maltese court has no further legal instruments at its disposal to compel Harbinson’s appearance. Expressing clear exasperation at the limitations imposed by jurisdictional boundaries, the judge remarked that her hands were tied, leaving the court “helpless with limited powers.”
In response to Harbinson’s persistent non-compliance, the court imposed a €500 fine — a symbolic sanction reflecting the court’s dwindling leverage. Moreover, Judge Grima ordered that should Harbinson ever set foot on Maltese soil, he is to be accompanied by court officials and brought to testify in an urgent sitting. However the Judge stated that she could not legally order an international arrest warrant.
The situation has raised eyebrows within legal and political circles alike. Harbinson, who has reportedly earned tens of millions of euros through his court expert service provision, appears to be beyond the effective reach of Maltese jurisdiction.
As things stand, Harbinson remains abroad and has not indicated any intention to cooperate with the court’s directives.
