In a concerning development, The Times of Malta, in an article by Jacob Borg, has once again today published excerpts from the confidential expert reports of the ElectroGas inquiry. These reports by the disgraced experts of Harbinson Forensics, which remain sealed by court order, have been selectively leaked, providing a skewed narrative that omits exculpatory evidence and prejudices the rights of the accused.
In January, Magistrate Rachel Montebello had already issued a decree emphasizing the confidentiality of all acts of the compilation. Reporting needed to be strictly on what was discussed in Court.

However the acts of the compilation have been leaked to the Times. The newspaper persists in disseminating information that contravenes court orders, raising serious concerns about the integrity of the judicial process and the protection of the accused’s rights.
The repeated breaches by The Times of Malta are not merely journalistic oversights but deliberate acts that undermine the legal framework designed to ensure fair trials. By publishing information that is legally restricted, the newspaper risks influencing public opinion and potentially swaying the course of justice.
It is imperative that Magistrate Montebello takes decisive action to address these violations. The continued disregard for court orders cannot be allowed to persist without consequence. The integrity of the judicial process must be upheld.
The public’s right to information is paramount, but it must not come at the expense of the legal rights of individuals facing charges. It is essential that media outlets adhere to rule of law and ethical standards, ensuring that their reporting does not interfere with the administration of justice.
